Structuring Employee Compensation Agreements: Design Choices, Legal Considerations, and Upcoming Overtime Regulation Changes

Employee compensation, especially for senior-level employees, encompasses more than just a salary, bonus, and benefits. Employers have a wide range of compensation vehicles to consider, including equity compensation (stock options, restricted stock, restricted stock units, etc.), performance-based incentive compensation, and change in control benefits.

 

On August 30, 2023, the United State Department of Labor announced a proposed regulation increasing the minimum salary required for jobs exempt from overtime. Specifically, while the prior threshold for workers to be exempt from overtime was $35,598 annually, the proposed regulation would increase that figure to $55,000 annually.

 

This presentation will offer an overview of the various types of compensation alternatives and a discussion of the circumstances in which each may make the most sense. In addition, we will review important legal considerations that apply when designing employee compensation packages. We will also help companies navigate the proposed changes to overtime exemption rules and audit other wage and hour issues that are commonly misapplied.

 

Lastly, we will provide companies with a comprehensive understanding of employee compensation, including both traditional and alternative compensation options, as well as the latest legal developments in this area.
